If you lodge EOI prior to skills assessment and you then get invited to apply you will be lodging an invalid application and get a refusal

Well of course it is not a good idea if you have a spare $50K and want an immediate solution, or not a good idea if you were not going to apply! This message is for the 100's of parents who can not afford the luxury of queue jumping. However, if you have family overseas who think they MAY wish to emigrate in the future $ 3K is a very little amount to keep your options open. Also for those parents onshore visiting they may look at lodging and remaining on a BVA whilst their application is processed. Also their are many people whose only option is the Remaining Relative or Carer, these will be closed for good, therefore not giving some people any option whatsoever of emigrating. Personally I would rather gamble $3K and sit in a queue than decide a few years down the line and then find out that the door is closed forever. Rumour is these streams will be closing before the end of the financial year.

Hello Perth Poms Many of you know I ocassionally contribute to this site, when time permits but usually only to give people advance warning wherever possible of important changes in legislation.. THIS IS VERY IMPORTANT AND MAY EFFECT MANY PERTHPOMS Following on from the Federal Budget this week, the Abbott Govt have announced that the Aged Parent, Remaining Relative and Carer visa will be axed. A date has not been announced but it is felt that this is likely to be before the end of the financial year and may be within the next week or two (could be less.) IMHO this sadly means that only those parents with a spare $50k will be able to move to Australia. It has allowed more places for partner visas in the programme as well. For anyone with parents on shore who are thinking of moving you may wish to get your 804 app in NOW!!! Go and see your Registered Migration Agent immediately to discuss the impact of these changes. This is not good news for the many parents out there who just do not have the huge amount of money required for a Contrib Parent The Family Stream will refocus on meeting the increasing demand for close family reunions. The additional partner and child places will be made available as a result of the cessation of new applications from the other family and parent (non-contributory) places. This cessation will also enable faster processing of existing applications," states the Budget Paper.

DIBP are now introducing credit card fees to all of its visa charges after 22 March 14. They obviously feel that their fees are too low!!! Rumoured to boost their bottomline by $14m! ATO charge just under .5% for visa/mastercard users, so may be in line with that, but no confirmation yet.

Assistant Immigration Minister Michaela Cash is set to announce an inquiry into the sc457 visa scheme, with a pledge to ensure the integrity of the program while scrapping any unnecessary red tape that holds business back, reports the Australian.[/h] [h=2]According to DIBP statistics, the number of 457 visa applications lodged in the year to December 31 fell 37.9 per cent to 23,420 compared to the previous year. Analysts put it largely to the previous government’s election tactics which tightened rules in order to appease union complaints about the scheme, which allows employers to bring in temporary workers from overseas.[/h] At least the new Government is doing something useful!

I totally disagree with this comment. Might be a good idea to consider accepting the 457 job offer to get you over to Australia and to see whether you are likely. This is incorrect, you CAN change job on a 457 as long as you get your new employer to take over the Nomination. I have nurses all the time changing their employers and relodging the nomination. You could come to Oz on a 457 to Sydney then if you are lucky you could transfer the nomination to a Perth employer and in this time you will building up one years work experience to claim more points for GSM? Worth considering! The other myth that seems to be strong in the nursing community is that you can not apply for PR for 2 years! Again this is incorrect, I have just done 5 RSMS visas for Reg Nurses who were on 457's. They demonstrated their abilities whilst on 457 then the employer was happy to employ them on 187's.

HI Lisa In reality I would say it would be a huge waste of money/effort to come here for one week! The majority of HR Advisors I know on a 457 are either ex HR Graduates from an Australian Uni or experienced under 30's who have managed to secure work visa the Working Holiday visa programme. Effectively the people I know have demonstarted their abilities whilst on a substantive visa with work rights and then been sponsored thereafter. Yes people are here on 457's within HR but things are getting a lot tighter here in Perth and I would think it highly unlikely that a company would wish to sponsor someone who was just here for a week and subject to relocation.You would have just as much chance applying via the UK and unless you had incredibly relevant experience to the advertised role imagine it would be very difficult to secure sponsorship. Sorry, sounds negative but that is the reality. We have lots of excellent international students with a BA in HR looking for sponsors here in Perth.

One more thing Portlaunay, your advice is very sound however, if this Nom was lodged Decision Ready, the case officer is well within their rights to make a decision on the information provided at time of application and does not need to request further info and can just refuse! As an agent I have never lodged DR as I dont want to give away the opportunity of submitting further evidence! However DR is no longer an option! Your advice about going ahead with penal clearances is a great idea

Hello RYU Firstly I must say what I always say on here, trust your agent! Believe it or not, as long as they are MARA registered they should know what they are doing! Have you asked your agent these questions? Firstly their strategy on lodging the Nom first is very good, as it appears that your agent has concerns with your employers training benchmark. Policy states with regards to 457 payroll that conferences may be counted towards the training benchmark B but ONLY if there is clear evidence that the conference provides a professional development to the attendee. So basically it would be determined on a case by case basis. This could be a concern as the employer needs to be mindful of their obligations as a SBS. Nom approvals vary in approval times, occupation and case load and the only guidelines that can be given are the ones published on the immi website. You are correct if you lodge your visa and your nomination is refused, you will then get a refusal (or you may get the opportunity to withdraw but you will not get your VAC back - costly!) Agents no longer have the opportunity to lodge decision ready and so your visa app will just go in the queue with everyone else. I think the advise you have been given is in your best interest and I would think it would be highly likely that your Nom decision will be determined before July. If there was a concern with the Training Requirements, why didnt you apply for a Subclass 187/RSMS as this is not a requirement for this visa. If your nom is refused on training, you may be best to lodge RSMS that is IF Perth remains regional rather than trying for a 186 again?? Hope that helps, Camilla

Hi Kezzles, be careful as VETASSESS usually require one years post grad experience before they will give a positive skills assessment. Maybe you should look at trying to get a 457 sponsor to get you over or even try a 417 if you are the right age. I know of a few HR advisors here who came on a working holiday and then got sponsored. READ the VETASSESS reqs carefully as you may get a second negative if not careful. A common mistake made by many.

Can you not get an employer to sponsor you? You can not get a BV to stay in the country unless you have lodged your visa so you will need to go offshore. I suggest you go back and see your immigration lawyer for some advice perhaps

Be warned, the advice of having 28 days to book medicals/Police Checks is a generic rule. Many visas require proof of medical/police check application at time of visa lodgement. Always check the criteria upon application, so as not to make an invalid application -

HI Lisa A common mistake is getting confused with what is said in the ANZSCO and what is required by the assessing body. Thats why many people are going via the RSMS visa stream as opposed to the independant as they may have more than enough experience to satisfy the ANZSCO but would not achieve a successfull skills assessment from Vetassess. For example many of the international students who have obtained a Degree in Australia meet the ANZSCO but do not meet Vetassess for a full assessment as they have not gained one years post grad experience. Maybe worth the HR person appealing for $220 if they can provide some excellent submissions. I argued one last month for a client and it was reversed within a week, so it is worth a try if you have evidence that this qualification is equivalent to a Bachelor and you have post grad experience. Perhaps a letter from the examining body and some information from the net may help, worth a go for $220???? Good luck -

Very sensible words portlaunay, couldnt agree more. The other thing to mention here that with regards to 457 and RSMS/ENS, project administrator and contracts administrator are two of the highest refused occupations. Half of Perth seems to be calling themselves a project administrator so its not surprising it has come off the list. Many of the advertised positions on Seek are probably to meet the RSMS reqs, so some of those jobs are essentially already filled. -

Hi Shona, as a nurse on a 457 you are not in a bad position. If you dont like your employer you can ask another 457 SBS to take over your nomination! I have recently just secured PR for some nurses who were on a 457 and were sponsored under the RSMS route. However, come, see if you like it and then worry about lodging PR. DIBP have really hiked the lodgement fees up twice this year, so it is a huge expense if you are not sure you want to remain. Many migrants return after less than 12 months, so come and see what you think. You have SOL1 occupation, so you are currently in a string position
