Guest pablo Posted June 19, 2013 Report Share Posted June 19, 2013 hi there, I've just had some bad news.... looks like by 457 visa will be cancelled before the month is out, due to a downtown in mining which we are tethered to. I'm busily hunting for a new job, but conscious I have 28days.... I plan to apply for a holiday/tourist via to extend that, but ... well... its tough. Major concern is finances, I have a loaded credit card and a small loan - if I get 'deported' what happens to these? Its not that I've been living above our means, just that being fresh off the plane (6+ months in), we took a hit on costs, having to use local credit cards. Any advice? Admin Posted June 20, 2013 Report Share Posted June 20, 2013 Your Australia credit rating will not have any affect what so ever on your UK credit rating. The only thing to consider is if you left Australia with unpaid debt, how it would effect you is you ever returned to Australia and some point in the future. If you have any outstanding govt debt - tax etc, then I'd prioritise paying that off. With regards credit card/loans etc, then I guess it comes down to what you feel comfortable doing. In reality, once you're back in the UK, there's very little chance of being perused for the debt. If you want to pay the debt off though, then try and arrange an Individual Voluntary arrangement to pay back the debt once you're back on your feet in the UK. I'm sure if you're google, there'll be services in Perth that offer free debt advice and who will liaise with creditors to put something in place. You should be able to make regular payments from the UK if that's what you decide to do. In the meantime, good luck with the job hunting. Unfortunately yes, the relevant conditions are: [h=3]Condition 8107 (employment conditions)[/h] You must comply with condition 8107 if you are the primary visa holder. Unless you were employed under the 'independent executive' stream, you must: work in the occupation for which you were nominated work for the sponsor who nominated the position you are working in, or an associated entity of the sponsor (if your sponsor is a standard business sponsor in Australia) not cease employment for a period of more than 28 consecutive days. You are considered to have ceased employment when either you or your employer notifies the department you will cease employment. If you cease working for your sponsor, you must do one of the following within 28 days (the 28 day period starts from the date you cease employment): find another employer to sponsor you (they need to lodge a nomination) apply for another type of substantive visa make appropriate arrangements to depart Australia. I feel bad for you, but I am sure I read somewhere that as long as the DIAC know that you are actively looking for a new sponsor then the 28 days may be extended??? Please dont quote me on that, as I am not sure and maybe someone else on here who is way more versed in these things could help. Rossmoyne always has some really good answers about this sort of thing, I wish you all the luck, I know the 457 visa is such a risk as its a temporary visa (although we came on one, PR after two years and now citizens, so I guess we are one of the lucky ones) hope things or something comes along and works out for you all. pea Quote Link to comment Share on other sites More sharing options...
fifi69 Posted June 20, 2013 Report Share Posted June 20, 2013 As others have said, don't look at a 457 visa as a permanent way into Oz. its always had its downsides but is really getting some stick now from all sides. Plenty in government are putting the boot in and of course now that mining is on a downturn there are plenty of Aussies looking for work back in jobs that they shunned before because of the bigger money being Fifo. best way to look at the 457 is it gives you the chance to work in another country for a set period of time, anything above that is a bonus. dont burn too many bridges, ie maybe rent out your house instead of selling and try and negotiate a decent relocation package so your not going to end up out of pocket is things don't work out like the OP. im not trying to be doom and gloom, we too are here on a 457 and its been fantastic, we love it, so are now going down the PR route cos we want to stay longer term.
