can daughter stay

Hi

 

We emigrated nearly a year ago and are thinking of returning to the uk, would there be any way my eldest could stay as she does not want to go back home, she is doing really well, has a great job, made lots of friends and has a great life here. Could her company sponsor her, and would it be any easier as she already has a PR visa?, or does it not make any difference.

Ok so correct the OP with the facts so we can all learn....

You need 4 years residency and the last year before applying has to be PR and since they only moved here last year its hardly likely they have met the requirements for citizenship. Its best not to give people the wrong information, if you are not sure dont post it!

Sorry to sound condescending but you do know that PR stands for PERMANENT RESIDENCY don't you? If so, it kind of makes you initial question redundant.

I did know it stands for permanent residency but as we came on a family visa was not too sure wether it meant she had to go back if we all went. Thanks for all the replies, she is 24, has a great job and a place to live and can financially look after herself, so hoping it will be ok, will give them a ring, and let you know what they say in case anyone else is in the same position

I'm pretty sure you cannot get australian passport (citizenship)until you have been resident for 4 years with no more than 90 days away in 12 months directly before application.

yeah, I heard you have to have been here for 4 years with no more than 90 days a year out of Australia, it used to be only 2 years, as friends and family who emigrated earlier only had to do 2 years before they got their citizenship

There's no hoping, she is fine to stay.

 

Although you all came together, there is no such thing as a family visa. You all have your own visas as individuals.

thankyou for taking the trouble to reply, it has taken a lot of worry of my mind, I really did think that if we went back that she wouldnt be able to stay, and I couldn't do that to her, but at the same time I knew I couldn't stay for another 3 years if I kept on feeling the way I do now,(I have promised everyone that I would give it another twelve months and am hoping I can settle, but knowing that I don't have to spoil things for her incase I end up going back will help me to relax now and who knows I may end up realizing that I can be happy and settle here), many thanks again

Before 2007 you could gain citizenship if you had been a PR for 2 years.

 

Now - it is 4 years residency with only 12 months out of Australia in those 4 years - PR for the last year and only 90 days out of the country.

 

If you validated your visas by a holiday then moved later - she could be eligible for citizenship earlier.

I thought that you could only get PR after you've been here for 2 years, is that wrong?
Yes its wrong, depending on what visa you qualify for you can get PR before you even step foot into the country! I think you are getting confused with applying for PR after being sponsored by an employer for 2 years.

But if you are here on a sponsored visa the ability to apply for PR is still open to you at any time.

Applying for PR after being in a sponsored position for more than two years means that you bypass any skills assessment, the logic being that having performed in the role for two years you have already demonstrated that particular skill or ability.
