ali Posted November 29, 2015 Report Share Posted November 29, 2015 Hi all, One of the agents who posts on PIO has posted re this ruling: On 11 June 2015, the Federal Court of Australia Full Court (FCAFC) found that a couple do not need to have lived together to satisfy the requirement of ‘live together or live separately and apart on a permanent basis’, which is prescribed in the s5CB definition of ‘de facto relationship’. This decision quashes the Federal Circuit’s decision of 26 March 2014, which found that a couple cannot meet the definition of de facto partners, as prescribed in s5CB of the Act, if they have never lived together. However, its application is still uncertain and I would strongly urge you to speak to a good agent if you think this may be something you will need to rely on. Hi hi just asking if anyone has any information on people applying for partner visa in defacto relationship...where the relationship has been for 3 yrs or more.....I read some blogs recently where people stated a PR visa would be issued immediately in these cases. all information on defacto visa experience greatly appreciated.....especially those where applicant applying for visa has supported there sponsor while living together out of Australia.
