Guest
Advice needed we were going to do last year but had a family issues here in uk. we are living in the uk but I've got my Austr.ian passport and been with my partner 3 years. we are going to oz in feb for a holiday but wondering if we should apply for a partner visa in the uk or when we are in oz. my partner is thinking of leaving work and maybe we go to oz for 6 months and apply for partner visa there. he won't work and can afford not to and I will work. any advice would be great. verystormy
You can apply in Oz, though he will need to be careful as it is technically not what a tourist visa is aimed at, so shipping things would be difficult, though I imagine you could ship in your name and people do do this. He would get a bridging visa on submitting the application and this would give work rights.
Guest
Could he get a bridging visa on just a regular tourist visa. if better applying uk that's what we will do and just go on holiday in feb,but if we can apply in feb while there and not return uk that would be better. as for shipping not an issue. verystormy
He can apply in Oz. If questioned, it is perfectly in the rules to say that he came on holiday and decided he wanted to stay. A bridging visa with full work rights would be automatically issued the moment he puts in his application for the partner visa.

New Life Down Under
Hello verystormy Just wanted to clarify what you said about the BVA, as there is a lot of confusion with them. What you said about a BVA being issued when they apply for the visa is correct, BUT, it doesnt come into effect until the current substantive visa expires. Therefore if they arrive on a tourist visa for 6 months, they will be on that tourist visa for 6 months (with NO work rights) until the Bridging Visa takes effect once that visa has expired.
